Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Fablito app (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms form a legally binding agreement between you and Slim Software Limited, a company registered in England and Wales (company number 09676113), with its registered office at 24 Dering Street, London, W1S 1BL (“Fablito,” “we,” “us,” or “our”).

2. Service Description

Fablito is an AI-powered personalised storybook app designed for children aged 3–8. Parents and guardians describe a story idea, and Fablito generates illustrated picture books complete with narration. The Service is available on iOS and may be expanded to additional platforms in the future.

3. Eligibility & Age Restrictions

You must be at least 18 years old to use Fablito. The Service is intended for use by parents and guardians on behalf of their children (aged 3–8). By using Fablito, you represent and warrant that you are at least 18 years of age and have the legal authority to agree to these Terms.

Fablito does not have user accounts. Your identity is tied to your Apple ID and iCloud account. Children should not operate the app independently — story creation, profile setup, and all interactions with our servers are designed to be performed by a parent or guardian.

4. User Content

When using Fablito, you may provide story prompts, your story nickname and age band, and optionally photographs of toys. You retain ownership of the content you provide (prompts, nicknames, and photos).

Stories generated by the Service — including text, illustrations, and audio narration — are licensed to you for personal, non-commercial use. You may share generated stories with family and friends, but you may not sell, sublicense, or distribute them commercially without our prior written consent.

5. AI-Generated Content

Stories created through Fablito are generated by artificial intelligence models. While we work hard to produce delightful, age-appropriate content, AI-generated stories may occasionally contain unexpected or imperfect results.

We include safety filters designed to block inappropriate content, but no automated system is perfect. We strongly encourage parents and guardians to review stories before sharing them with children.

No AI training on your data: Your story prompts, story nicknames, toy photos, and generated stories are never used to train or improve AI models. They are processed solely to generate your requested story and then discarded from our servers.

6. Subscriptions & Billing

Fablito offers the following plans:

• Free: 15 scenes per month, up to 10 scenes per story, 4 art styles.
• Fablito+ (Premium):$9.99/month or $79.99/year (save 33%) — 75 scenes per month, up to 15 scenes per story, all 8 art styles, the My Toy feature, Story Sequels, and premium narration voice. Includes a 7-day free trial.

Premium subscriptions are billed through the Apple App Store. Apple’s terms and conditions apply to all purchases. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription at any time in your iOS Settings under Subscriptions. Cancellation takes effect at the end of the current billing period; no partial refunds are provided. For families using Apple’s Family Sharing, purchases may be subject to Apple’s “Ask to Buy” feature.

7. Acceptable Use

You agree not to use Fablito to:

• Submit prompts that are harmful, abusive, threatening, obscene, or otherwise objectionable.
• Attempt to generate content that is illegal, discriminatory, or exploitative.
• Circumvent, disable, or interfere with the Service’s safety filters or security features.
• Use the Service in any way that violates applicable laws or regulations.

Our safety filters automatically block inappropriate content. Fablito uses content moderation to ensure stories remain age-appropriate. Repeated attempts to misuse the Service may result in suspension of access.

8. Intellectual Property

The Fablito name, brand, mascot, logo, app design, and all underlying technology are owned by Fablito and protected by intellectual property laws. Generated story content is licensed to you for personal use as described in Section 4. Nothing in these Terms grants you any right, title, or interest in our brand, trademarks, or proprietary technology.

9. Data & Privacy

Your privacy matters to us, especially when children are involved. Fablito complies with the Children’s Online Privacy Protection Act (COPPA). Please review our Privacy Policy to understand how we collect, use, and protect your information. By using Fablito, you also agree to the terms of our Privacy Policy. Your use of the iOS app is also governed by our End User License Agreement.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated content may contain imperfections, inaccuracies, or unexpected results. We disclaim all warranties to the fullest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Fablito and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, without prior notice or liability. You may stop using the Service at any time. Upon termination, your licence to use generated content remains in effect for stories already created, but you will lose access to the Service and any unredeemed story credits.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by other reasonable means. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
